Terms of Service

1. Acceptance of Terms

By accessing and using Ampere.sh ("the Service"), provided by Ampere ("we," "us," or "our"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Ampere.sh provides managed hosting services for OpenClaw instances on Virtual Private Servers (VPS). We provide the infrastructure (compute, networking, and storage) to run your AI agents. We do not provide the AI models themselves; you must provide your own API keys for third-party LLM providers.

3. User Accounts

To use our Service, you must create an account using a valid email address. Authentication is managed via Firebase Auth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate your account if we suspect any unauthorized use or violation of these Terms.

4. Billing and Payments

  • Payment Processing: Payments are processed securely via Stripe. We do not store your full credit card information on our servers.
  • Subscriptions: Services are billed on a recurring subscription basis. You agree to pay all fees associated with your subscription.
  • Cancellations: You may cancel your subscription at any time. Upon cancellation, your service will remain active until the end of the current billing period, after which your instance and data will be deleted.
  • Refunds: Refunds are handled on a case-by-case basis. Please contact support if you believe you are entitled to a refund.

5. User Responsibilities and Prohibited Conduct

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Specifically, you agree NOT to:

  • Use the Service to generate or disseminate illegal content, hate speech, or harassment.
  • Attempt to bypass security measures or access other users' instances.
  • Use the Service for crypto-mining, denial-of-service attacks, or other malicious activities.
  • Violate the terms of service of the third-party LLM providers (e.g., Anthropic, OpenAI) that you connect to via our Service.

6. Data Privacy and Security

Your use of the Service is also governed by our Privacy Policy. We prioritize your privacy and do not access your message content or API keys, except for the purpose of automated provisioning and encryption.

7. Service Availability and Termination

We strive to maintain high availability of our Service but do not guarantee 100% uptime. We use Hetzner Cloud for infrastructure and are subject to their availability.

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Ampere.sh makes no warranties, expressed or implied, regarding the operation of the Service or the information, content, or materials included therein.

9. Limitation of Liability

In no event shall Ampere.sh, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
